BEFORE JOE AJAERO PLUNGES NIGERIA IN TO CIVIL AND ETHNIC WAR THROUGH VIOLENT POLITICAL INSURRECTION: TIME TO BE DECISIVE IS NOW
Dear Sir
(1) I have decided to write this open letter to you first as a concerned citizen of the Federal Republic of Nigeria who valued corporate sanctity , unity and continuous existence of our dear country . Secondly as a member of Labour party in my capacity as the National Publicity Secretary
(2) On the 13th of August 2024, our party raises an alarm about Joe Ajaero and his NLC /NTC( ILLEGAL NATIONAL TRANSITION COMMITTEE) are turning themselves to plaques and security threats to the continuous existence of our dear country
(3) They are planning to forcefully takes over Labour party through unconstitutional and Clandestine legal aides provided for them by Chief Femi Falana SAN against trade union acts and miscellaneous acts and that the primary aims and objectives of Joe Ajaero NLC/ NTC conclusively is to use Labour party once he succeeded in his in- ordinate and expansionist agenda to cause a violent insurrection and plunges Nigeria in to another Civil and Ethnic war which will ultimately destabilizes our country and bring our hard earned 25 years of unbroken Democracy to an abrupt end
(4) It's on records that Joe Ajaero and Com Emmanuel Ugboaja over four times invaded our party National Headquarters with hundreds of armed thugs in over 40 buses with dangerous weapons and canisters that was thrown in the premises of our party Secretariat in order to assassinate the National Chairman Barrister Julius Abure and National Secretary Alh Farouk Umar Ibrahim. Our party need to bring your attention to this as we are shocked as to how and where he got those numbers of criminals with such dangerous weapons to invade and brought down the main gate to carried out his assassination plots
(5 ) I also officially on behalf of our party National Working Committee drew the attention of the, National Security Adviser, Chief of Defence Staff , Director General Of Department of State Services and your good self about the Clandestine plans by the President of the Nigeria Labour Congress Comrade Joe Ajaero, the former President of NLC, Comrade Abdulwaheed Omar who is also a member of New Nigeria People's Party (NNPP),to levies war against the State, in order to intimidate or overawe the President of the Federal Republic of Nigeria and overthrow the civilian administration
(6) We further drew your attention and that of other security departments to Comrade Joe Ajaero purported, Unending, misguided, mischievous and unconstitutional letter of introduction which is against trade union acts section 15(2) to the Independent National Electoral Commission Chairman.
(7) The letter written by Joe Ajaero and Com Ugboaja Emmanuel to the National Chairman of INEC was dated 31st May 2024 but was received by INEC on the 5th June introduce the illegal duo of Comrade Abdulwaheed Omar and one Engr. Nnawuihe A Nwauwa as National Transitions Committee (NTC) Chairman and Secretary of the Labour Party against trade union acts section 15.
(8 ) Our party wishes to further intimate you that the NLC'S letter to INEC contradicts trade union acts section 15 (1) (2) (3) which says that trade union dues must not to be applied for political purposes:
(9) Section 15(I) says: Unless the rules of a trade union otherwise provide, in so far as the funds of a trade union represent payments which the members are required to make under the rules, whether by way of subscriptions, dues or otherwise, those funds shall not be applied (whether directly, or through any other union, association or body, or in any other indirect manner) to the furtherance of any political objective.
(10)Section 15 (2) If any of the funds of a trade union are applied to the furtherance of political ob- objective in contravention of subsection (I) of this section the trade union and every official thereof shall be guilty of an offence under this Act.
(11)Section 15 (3) The following objectives, and no others, are political objectives for the purposes of this section, that is to say-
(a) the making of contributions towards the funds of any political party;
(b) the payment of any expenses incurred (whether directly or indirectly) by a can- candidate or prospective candidate for election to any political office in Nigeria or any part of Nigeria, being expenses incurred before, during or after election.
(12) Further more , on the 31st July 2024 the Federal Ministry of Labour and Employment via a letter with ref nos: ML.IK/11/VIII/109 caution the Nigeria Labour Congress to be guided by the provision of trade union Acts section 15(1)(2)(3) CAP T 14 & T 15 Laws of the Federation Of Nigeria 2004
(13) After the election of Comrade Joe Ajaero as the President of Nigeria Labour Congress on 8 February 2024, he has embarked on actions that appears to be against the corporate existence of Nigeria similar to the attributes of the outlawed Indigenous People of Biafra, IPOB,
(14) Com Joe Ajaero has deliberately adopted a combative and confrontational militancy against the federal Government and her properties , some state governments, and Labour party National Chairman Barrister Julius Abure, National Secretary Alh Farouk Umar Ibrahim and other members of the party National Working Committee , an action that could lead to economic sabotage of the country.
(15) Com Joe Ajaero is playing an ethnic card against the unity , constitution and President of the Federal Republic of Nigeria Asiwaju Bola Ahmed Tinubu by his unwarranted, clandestine and violent attempt to removed Bar Julius Abure and Alh Farouk Umar Ibrahim using the NLC platform to prosecute such a sinister agenda of violent political insurrection against Nigeria using Labour party.
(16) Nigerian security agencies, ought to be alarmed about this treasonable conduct because for those who don’t know his history, Ajaero was once involved in splitting the NLC when he lost the presidency to the former president, Comrade Ayuba Wabba where Ajaero went on to form the United Labour Congress (ULC) which later collapsed as that ultimately exposes his desperation that he needed the NLC platform for an agenda that has nothing to do with the defence of workers’ rights.
(17) Because of the devilish ethnic agenda of the duo of Comrade Ajaero and the Secretary General of NLC, Comrade Emmanuel Ugboaja working alongside some highly placed Nigerians political assassins, Ajaero now wants to use the platform of the NLC and Labour party to End Nigeria Democracy
(18) Labour party as earlier canvassed before now hold no grudges against Ajaero provided he was pursuing his agenda as a private citizen within the ambit of the law, but his plans to use the platform of the NLC, a body that has millions of members with diverse political interests to promote his treasonable Clandestine plans to cause a violent insurrection is totally unacceptable to our party leadership
(19) For explicit clarifications, there is a huge difference between the NLC and the Labour Party. While the former represents the workers, the latter is a political party which platform is used to contest elections. One can be a member of one without necessarily supporting the other.
(20) It's on records that Dr. Olusegun Mimiko, who was never a member of NLC contested election under the Labour Party and won to become Governor of Ondo State.
(21) Also it's not a dispute that Comrade Adams Oshiomhole who was once the president of NLC ran for Edo State governorship not under Labour Party but Action Congress of Nigeria.
(22) Alh Nasir Idris who was a former chairman of NUT and NLC in Kebbi State and former National Treasurer of NUT won the Governorship Election of Kebbi State under APC even as his ambition was supported by former NLC president, Comrade Ayuba Wabba.
These are all great men who knew the explicit difference between NLC and Labour Party and separated same unlike the political misfits terrorist Com Joe Ajaero.
(23) It's very obvious that Com Joe Ajaero is unable to distinguish his personal ambition with that of the NLC and has thus gone ahead to embrace threats and blackmail in his infantile quest to assassinate Nigeria Democracy thus should be designated as a terrorist and national security risk going by his antecedents.
(24) Dear IGP Sir, with due respect to the invitation issued out to the President Of The Nigeria Labour Congress NLC over his alleged Criminal Conspiracy, Terrorism Financing, Treasonable Felony, Subversion, and Cybercrime which he declined to honour because he claimed he had other obligations base on his lawyer chief Femi Falana SAN is a welcome development that will make our democracy safer
(25) What is manifestly worry some was the deliberate constitutional distortions by Chief Femi Falana SAN where in their letter to your good office , the law firm invoked Section 36 of the Nigerian Constitution, in Favour of Ajaero claiming he has the right to be fully informed of the charges leveled against him before honouring the invitation knowing fully well Ajaero has a terrorist as tenant on the second floor of the NLC building
(26) Labour party hereby wishes to educate the NLC lawyer that he is not the chief Law officer of the Federation nor the court to order the police to give details of every infractions involved in allegations before the suspect can honour police invitation and thus consequently, chief Femi Falana SAN unconstitutionally proposes a new date—Wednesday, August 29, 2024—for the police interview.
(27) Meanwhile, the union has declared that they will embark on a nationwide strike action if Joe Ajaero is arrested or detained during their emergency NEC meeting held virtually on Tuesday forgetting that there is no law backing such impunity in our constitution or trade union acts
(28) For the avoidance of doubt, we want to remind Chief Femi Falana SAN that his positions on section 36 with respect to police invitation for crimes such as alleged Criminal Conspiracy, Terrorism Financing, Treasonable Felony, Subversion, and Cybercrime is lace with falsehoods and wholesome misrepresentation
(29)For the avoidance of doubt , Section 36 (1) (5) (6)a,b and c of the Constitution of the Federal Republic of Nigeria states as follows:
(1) In the determination of his civil rights and obligations, including any question or determination by or against any government or authority, a person shall be entitled to a fair hearing within a reasonable time by a court or other tribunal established by law and constituted in such manner as to secure its independence and impartiality
5) Every person who is charged with a criminal offence shall be presumed to be innocent until he is proved guilty;
Provided that nothing in this section shall invalidate any law by reason only that the law imposes upon any such person the burden of proving particular facts.
(6) Every person who is charged with a criminal offence shall be entitled to -
(a) be informed promptly in the language that he understands and in detail of the nature of the offence;
(b) be given adequate time and facilities for the preparation of his defence;
(c) defend himself in person or by legal practitioners of his own choice;
(30) Section 36 sub 6(a)(b)(c) only involved any person who has been charged with criminal offence and not an allegations which the suspect has not responded to. May it please the learned Silk to observe this sub sections critically so that his client will not be mislead
(31) Mr IGP Sir, Joe Ajaero attempted economy sabotage where- in he successfully paralyzed the nation economy when he switched off our National Grid knowing fully well it's against the miscellaneous acts and is still fresh in our memory
(32).His attempt to unseat the Governor of Imo State just to foist his stooges and class mate as NLC State chairman where Joe Ajaero reportedly used some members to disrupt flights to and from Imo State under the guise that the workers May Day celebration will be disrupted is still very fresh in our memory
(33) The NLC unlawful use of violence or threats to intimidate or coerce a civilian population or government, with the goal of furthering political objectives of forceful take over of Labour Party for his presidential ambitions via planned violent insurrection is unconstitutional and unacceptable .
(34)Joe Ajaero has consistently engages himself in unlawful use or threat of violence especially against the Nigerian state or the public ( Labour party National Chairman Barrister Julius Abure and National Secretary Alh Farouk Umar Ibrahim) as a politically motivated means of attack or coercion is absolute terrorism and treasons
(35) Finally Sir , because Ajaero no longer recognises his limits simply because he had elevated himself as an opposition leader rather than the NLC president which made him to consistently engages himself is dangerous to our young Democracy and severe action must be taken now against him and his sponsors
(36) If the NLC president is not made to face the full weight of the Law as prescribed in the constitution for treasonable felony offense and terrorism financing , then we should forget election in 2027 because the NLC would have transformed into a full militant group capable of assassinating our democracy where he will then carried out his plans to overthrown President Bola Ahmed Tinubu and ultimately that would signal the beginning of another Civil and Ethnic war
